1. Scope of Application
1.1
These General Terms and Conditions (GTC) apply to all contracts for the delivery of goods concluded by a consumer or entrepreneur through the Hundredlevels online shop.
1.2
A consumer within the meaning of these GTC is any natural person who concludes a legal transaction for purposes that are predominantly neither commercial nor their independent professional activity (§ 13 BGB).
1.3
An entrepreneur within the meaning of these GTC is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of their commercial or independent professional activity (§ 14 BGB).
1.4
Deviating conditions of the customer are not recognized unless we have expressly agreed to their validity in writing.
2. Conclusion of Contract
2.1
The products displayed in the online shop do not constitute a legally binding offer, but an non-binding invitation to place an order.
2.2
By clicking the order button, the customer submits a binding offer to conclude a purchase contract (§ 145 BGB).
2.3
The contract is concluded as soon as the seller:
• sends an order confirmation by email or
• ships the goods.
2.4
The contract text is stored by the seller and sent to the customer by email after the order.
3. Right of Withdrawal
3.1
Consumers generally have a statutory right of withdrawal.
3.2
The withdrawal period is 14 days from the day on which the customer or a third party named by him received the goods (§ 355 BGB).
3.3
To exercise the right of withdrawal, the customer must inform the seller of their decision by means of a clear statement.
3.4

4. Prices and Payment Terms
4.1
All prices in the online shop are final prices and include the statutory value-added tax, unless otherwise stated (§ 1 Price Indication Ordinance).
4.2
In addition to the stated prices, shipping costs may apply, which are shown separately in the ordering process.
4.3
Various payment methods are available to the customer, for example:
• Credit card
• PayPal
• Apple Pay
• Google Pay
• Shopify Payments
4.4
Payment is due immediately after conclusion of the contract, unless otherwise agreed.
5. Delivery and Shipping Conditions
5.1
Delivery is made to the delivery address specified by the customer.
5.2
The delivery time is stated on the respective product page.
5.3
If a product is not available, the customer will be informed immediately.
5.4
For consumers, the risk of accidental loss or accidental deterioration of the goods passes only upon delivery of the goods (§ 446 BGB).
6. Retention of Title
6.1
The goods remain the property of the seller until full payment (§ 449 BGB).
6.2
The customer is obliged to treat the goods with care until full payment.
7. Liability for Defects (Warranty)
7.1
The statutory warranty rights apply (§§ 434 et seq. BGB).
7.2
In the event of a defect, the customer is initially entitled to supplementary performance (§ 439 BGB).
7.3
Supplementary performance can be effected through:
• Replacement delivery or
• Rectification.
7.4
If supplementary performance fails, the customer can:
• Reduce the purchase price (§ 441 BGB) or
• Withdraw from the contract (§ 323 BGB).
8. Liability
8.1
We are liable without limitation for damages resulting from injury to life, body or health, as well as for damages based on intent or gross negligence.
8.2
In the event of slight negligence in the breach of essential contractual obligations (cardinal obligations), we are only liable for the typical, foreseeable damage. Essential contractual obligations are those whose fulfillment is essential for the proper execution of the contract and on whose observance the customer may regularly rely.
8.3
Otherwise, liability for damages is excluded.
8.4
Liability under the Product Liability Act, for fraudulent concealment of a defect, for the assumption of a guarantee, and due to other legally mandatory liability provisions remains unaffected.
8.5
The above liability provisions also apply to our legal representatives, employees, and vicarious agents.
9. Applicable Law
9.1
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
9.2
For consumers, this choice of law only applies insofar as it does not restrict mandatory statutory provisions of the state in which the consumer has their habitual residence.
10. Alternative Dispute Resolution
We are not obligated and not willing to participate in dispute resolution proceedings before a consumer arbitration board (§ 36 VSBG).
11. Online Shop Terms
By using this website, you agree to these terms.
You undertake, in particular, not to:
• use the website for illegal purposes
• circumvent any security mechanisms
• distribute malware.

We reserve the right to:
• change the service at any time
• block access
• discontinue features.
13. Accuracy and Timeliness of Information
We strive for accurate and up-to-date information. Nevertheless, errors may occasionally occur.
14. Changes to Service and Prices
Prices and services may be changed at any time without prior notice.
Price changes apply exclusively to future orders and do not affect contracts already concluded.
15. Products or Services
Products may only be available online and sometimes only in limited quantities.
16. Orders and Account Information
We reserve the right to refuse or cancel orders if there is a factual reason for doing so, particularly in cases of suspected fraud, obvious pricing errors, or abusive use.
17. Payment Information
All payment information must be accurate and complete.

Our website may contain third-party tools, the use of which is at your own risk.
19. Third-Party Links
Our website may contain links to external websites over whose content we have no influence.
20. User Comments, Feedback, and Submissions
By submitting comments or feedback, the user grants us a non-exclusive, perpetual, and geographically unrestricted right of use, to the extent necessary for the publication or processing of the content.

The processing of personal data is carried out in accordance with our Privacy Policy.
22. Errors, Inaccuracies, and Omissions
We reserve the right to correct errors at any time and to cancel orders if necessary.
23. Prohibited Uses
It is prohibited to use our website:
• for illegal purposes
• to violate laws
• to distribute malware
• to discriminate against or harass others.
24. Indemnification
The user undertakes to indemnify Hundredlevels from third-party claims arising from a violation of these terms.
25. Severability Clause
Should any provision of these GTC be invalid, the validity of the remaining provisions shall remain unaffected.
26. Termination
We reserve the right to terminate access to our services at any time if these terms are violated.
27. Entire Agreement
These GTC constitute the entire agreement between you and Hundredlevels.
28. Code of Conduct
By using our shop and interacting with the Hundredlevels brand you agree to the Code of Conduct and undertake to respect these values.
